TERMS & CONDITIONS

Welcome to curetoursindia.com (the "Site"), operated by Cure Tour India Pvt. Ltd. ("CTI", "Company", "we", "us", or "our"), a company assisting international and domestic patients in accessing medical, dental, cosmetic, fertility, wellness, and related healthcare services from hospitals, clinics, and healthcare providers located in India ("Healthcare Providers"). Our services include, without limitation, treatment planning assistance, provider introductions, cost estimates, itinerary and travel coordination, translator arrangement, accommodation assistance, and post-treatment follow-up coordination (collectively, the "Services").

These Terms & Conditions ("Terms") govern your access to and use of the Site and the Services. By accessing the Site, submitting an enquiry, booking a consultation, or otherwise using the Services, you ("User", "Patient", "Client", "you", "your") agree to be legally bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree with these Terms, please discontinue use of the Site and the Services immediately.

If you are accessing or using the Services on behalf of another person (for example, as a family member, caregiver, or authorized representative of a patient), you represent and warrant that you have full authority to bind that person to these Terms, and references to "you" shall include that person as applicable.

1. Eligibility

The Site and Services are intended for use by individuals who are at least 18 years of age and who have the legal capacity to enter into a binding contract. If you are under 18, you may use the Site only with the involvement, supervision, and consent of a parent or legal guardian, who shall be responsible for all actions taken and agreements made on your behalf. By using the Services, you represent that all information you provide is accurate, current, and complete.

2. Nature of Our Services

CTI is a medical travel facilitation company. We are not a hospital, clinic, medical practice, or insurer, and we do not employ or supervise the doctors, surgeons, nurses, or other clinical staff who provide treatment. All diagnosis, treatment recommendations, surgical procedures, and clinical care are independently provided by third-party Healthcare Providers who are solely responsible for the quality, safety, and outcome of the medical services rendered.

Our role is limited to facilitation and coordination, which may include:

  • Understanding your medical requirements and connecting you with suitable Healthcare Providers in India;
  • Sharing indicative cost estimates, which are subject to change based on the Healthcare Provider's final clinical assessment;
  • Assisting with travel logistics such as visa-invitation letters, airport transfers, and accommodation recommendations;
  • Coordinating communication between you and the Healthcare Provider before, during, and after treatment;
  • Providing general information about aftercare, recovery, and follow-up options.

Nothing on the Site, and no communication from CTI (including by email, phone, chat, or in person), constitutes medical advice, a medical opinion, or a diagnosis. All decisions relating to your treatment must be made in direct consultation with, and are the sole responsibility of, the treating Healthcare Provider.

3. Not for Medical Emergencies

Medical travel arranged through CTI is intended for planned, elective, or pre-scheduled treatment and is not intended or suitable for acute medical emergencies. CTI is not responsible for handling medical emergencies that arise during your transit or travel to, from, or within India.

If you experience a medical emergency at any point before, during, or after your journey, you must contact local emergency services or the immediate treating hospital directly without delay. CTI shall not be responsible for any medical issues of any kind whatsoever that arise while you are travelling for treatment to India and back to your home country, including issues arising during transit, at any stopover, or after the advised treatment has concluded.

4. User Representation

By visiting the Site, you represent, warrant and agree that:

  • The details provided by you are true, accurate, and complete;
  • You have the legal capacity and agree to comply with these Terms;
  • You are not under the age of 18, or if you are, you are accompanied by, and acting with the consent of, a parent or legal guardian;
  • You are not barred from using the Services or accessing the Site under the laws of India or any other applicable jurisdiction;
  • You will not use the Site for any illegal or unauthorized purpose;
  • Your use of the Site will not violate any applicable law or these Terms.

5. User Restrictions

By visiting the Site, you agree that you will not:

  • Use the Site or Services for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
  • Provide false, misleading, or fraudulent medical, personal, or payment information;
  • Attempt to gain unauthorized access to the Site, our servers, or any systems or networks connected to the Site;
  • Use any automated means (bots, scrapers, or data-mining tools) to extract data from the Site without our prior written consent;
  • Interfere with, disrupt, or place an undue burden on the Site's infrastructure;
  • Harass, threaten, or abuse our staff, representatives, partner Healthcare Providers, or their personnel;
  • Copy, reproduce, republish, or exploit any content from the Site for commercial purposes without express written permission;
  • Circumvent CTI to contract directly with a Healthcare Provider we introduced to you within twelve (12) months of the introduction, without our knowledge, where a facilitation fee or commission would otherwise be payable to us.

6. Cost Estimates, Fees, and Payments

Any cost estimate provided by CTI or displayed on the Site is indicative only and is based on the information available at the time it is prepared. Final treatment costs are determined solely by the relevant Healthcare Provider following an in-person or virtual clinical assessment and may vary due to factors including but not limited to the complexity of your condition, choice of implants or materials, length of hospital stay, room category, additional tests, and any complications arising during treatment.

Where CTI charges a service, consultation, or facilitation fee, the amount, applicable taxes, and payment schedule will be communicated to you in writing (including by email) prior to payment. Fees paid to CTI for facilitation services are separate from, and in addition to, amounts payable directly to Healthcare Providers, hospitals, hotels, airlines, or other third parties, which you are responsible for settling directly with those parties unless otherwise agreed in writing.

Refunds of any fees paid to CTI are governed by our Cancellation & Refund Policy, available on the Site or on request. Refunds of amounts paid directly to a Healthcare Provider, hospital, or accommodation are governed solely by that third party's own refund policy, and CTI shall have no liability in respect of such amounts.

7. Third-Party Healthcare Providers and Service Partners

CTI exercises reasonable diligence in selecting reputable and appropriately accredited Healthcare Providers and service partners (including hospitals, clinics, hotels, transport operators, and interpreters) for referral. However, we do not control, and are not responsible or liable for, the acts, omissions, professional judgment, clinical outcomes, pricing changes, or service quality of any third-party Healthcare Provider or partner.

Any agreement for medical treatment, accommodation, transport, or other services is a separate contract directly between you and the relevant third party, governed by that party's own terms, consent forms, and policies. You are strongly encouraged to review and understand any consent forms, treatment agreements, and cancellation policies presented by a Healthcare Provider before proceeding with treatment.

8. Medical Risk Acknowledgment

You acknowledge that all medical, surgical, dental, fertility, and cosmetic procedures carry inherent risks, including but not limited to the risk of complications, infection, adverse reaction, unsatisfactory outcome, or, in rare cases, death, regardless of where the procedure is performed. CTI does not guarantee any specific treatment outcome, recovery timeline, or level of satisfaction with the results of any procedure. Any testimonials, before-and-after images, or success stories displayed on the Site are illustrative of individual past experiences and do not constitute a promise or guarantee of similar results for you.

You are responsible for obtaining appropriate travel insurance and, where applicable, medical/health insurance that covers treatment abroad, cancellations, and medical evacuation. CTI strongly recommends that you consult your personal physician before undertaking international travel for treatment, particularly if you have pre-existing conditions.

9. Travel Documentation and Visas

Where we assist with medical visa invitation letters or related documentation, this assistance is provided on a best-efforts basis only. CTI does not control, and is not responsible for, decisions made by consulates, embassies, immigration authorities, or airlines, including visa refusals, delays, or denial of boarding. You are solely responsible for ensuring you hold valid travel documents, visas, and any health clearances required for travel to and within India.

10. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, the CTI name and marks, icons, images, videos, page layout, and the underlying software and design, is the property of CTI or its licensors and is protected under applicable copyright, trademark, and other intellectual property laws. Except as expressly permitted under these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your personal, non-commercial use in connection with evaluating or receiving the Services. This licence does not include any right to resell, sublicense, or commercially exploit the Site or its content, to use any data-mining or extraction tools, or to use our name, logo, or trademarks without prior written permission.

12. Privacy and Confidentiality of Medical Information

We understand the sensitivity of medical and personal information shared with us. Our collection, use, storage, and disclosure of your personal and medical information is governed by our Privacy Policy. By using the Site and Services, you consent to the collection and processing of your information as described in the Privacy Policy, including sharing relevant medical information with Healthcare Providers strictly for the purpose of facilitating your treatment.

13. Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. CTI DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENTNESS OF ANY INFORMATION ON THE SITE, INCLUDING COST ESTIMATES, TREATMENT DESCRIPTIONS, OR PROVIDER CREDENTIALS, WHICH ARE PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CTI, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR MULTIPLE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH:

  • (a) any medical treatment provided to you;
  • (b) the conduct of any doctor, hospital, clinic, or other hospital or Healthcare Provider staff;
  • (c) any claim in reference to any insurance disputes;
  • (d) your use of, or inability to use, the Site or Services;
  • (e) any act, omission, delay, or error of any third-party partner, including hospitals, hotels, transport providers, or airlines; or
  • (f) unauthorized access to or alteration of your information,

EVEN IF CTI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR ISSUES.

Subject to applicable law, and without limiting the disclaimers above, CTI's total aggregate liability to you arising out of or relating to these Terms or the Services, however arising, shall not exceed the total facilitation or service fees actually paid by you to CTI (excluding any amounts paid directly to third-party Healthcare Providers or partners) in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms shall be construed to limit or exclude liability for death or personal injury caused by CTI's own gross negligence or wilful misconduct, or any other liability that cannot be excluded or limited under applicable law.

15. Indemnification

You (the patient/client) agree to defend, indemnify, and hold harmless CTI, its affiliates, and their respective directors, officers, employees, and agents from and against any loss, damage, liability, claim, or demand, including reasonable legal fees, made by any third party and/or any treating hospital, due to or arising out of:

  • Your breach of these Terms or non-compliance with any obligation under these Terms;
  • Inaccurate, incomplete, or misleading information provided by you;
  • Any payment issues, including delayed, disputed, or unpaid amounts owed by you to CTI or to any Healthcare Provider, hotel, or other third party;
  • Your violation of any law or the rights of any third party; or
  • Your use or misuse of the Site or Services.

16. Communications and Marketing

By submitting an enquiry or creating an account, you consent to being contacted by CTI via email, phone, SMS, and messaging applications (including WhatsApp) for the purpose of responding to your enquiry, coordinating your treatment, and providing related updates. You may opt out of promotional/marketing communications at any time by using the unsubscribe link in our emails or by contacting us directly; you will, however, continue to receive essential transactional communications relating to any active enquiry or booking.

17. Termination and Suspension

We may suspend or terminate your access to the Site or Services, without prior notice, if we reasonably believe you have violated these Terms, provided false information, engaged in abusive conduct, or acted in a manner that could harm CTI, our partners, or other users. You may stop using the Site and Services at any time. Termination shall not affect any rights, obligations, or liabilities that accrued prior to the date of termination, including any outstanding payment obligations.

18. Modifications to the Site, Services, and Terms

We reserve the right to modify, suspend, or discontinue any part of the Site or Services at any time, with or without notice. We may also revise these Terms from time to time by posting the updated version on the Site with a revised "Last updated" date. Material changes will, where practicable, be notified to you by email or a prominent notice on the Site. Your continued use of the Site or Services after any such change constitutes your acceptance of the revised Terms.

19. Governing Law and Dispute Resolution

These Terms and any dispute, controversy, or claim arising out of or in connection with them (a "Dispute") shall be governed by and construed in accordance with the Applicable Law of the Republic of India, without regard to its conflict-of-laws principles.

If any Dispute arises, the parties shall use all reasonable endeavours to resolve the matter amicably. Any party which claims that a Dispute has arisen shall issue a written notice to the other party as soon as practicable after the occurrence of the event, matter, or thing which is the subject of such Dispute ("Dispute Notice").

If the parties are unable to resolve the Dispute within thirty (30) days of the date of receipt of the Dispute Notice by the recipient party ("Resolution Period"), then such Dispute shall be referred to, and finally decided by, arbitration before a sole arbitrator appointed by CTI, conducted in accordance with the (Indian) Arbitration and Conciliation Act, 1996, as in effect at the time of the arbitration. The seat and venue of arbitration shall be Delhi, India, and the language of the arbitral proceedings shall be English.

Subject to the foregoing, the parties submit to the exclusive jurisdiction of the courts at Delhi, India.

20. Force Majeure

CTI shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from causes beyond its reasonable control, including acts of God, natural disasters, epidemic or pandemic, war, terrorism, civil unrest, governmental action, travel restrictions, strikes, or failures of third-party infrastructure or service providers.

21. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect. No failure or delay by CTI in exercising any right under these Terms shall operate as a waiver of that right.

22. Entire Agreement

These Terms, together with our Privacy Policy and any Cancellation & Refund Policy, constitute the entire agreement between you and CTI relating to your use of the Site and Services, and supersede any prior agreements or understandings, whether written or oral, on the subject matter herein. In the event of a conflict between these Terms and a separately signed treatment coordination agreement between you and CTI, the separately signed agreement shall prevail with respect to the specific matters it addresses.
